Why Is Wet Ink in One Room Safer?
Legal Consolidated requires wet-ink signatures for its Enduring Powers of Attorney and medical or lifestyle decision-making documents throughout Australia.
The safest course is simple. The person giving the POA and the witnesses sit in the same room. Everyone signs in wet ink with the same coloured pen.
Banks, hospitals, aged-care providers and land registries know what they are looking at. No one has to explain an electronic signature, video link, scanned counterpart or remote-witnessing endorsement.
What does signing a POA Online mean?
People use ‘electronic signing’ to describe two different processes. The law does not.
- Electronic signing means typing, drawing or inserting a signature electronically. DocuSign is one example. The document has no handwritten signature.
- Video witnessing means the witness watches the POA maker sign through Zoom, Microsoft Teams or another live video link. The POA maker still signs the paper document in wet ink.
An NSW POA witnessed by video is not electronically signed. It is a wet-ink document witnessed online.
Legal Consolidated’s wet-ink rule does not prevent video witnessing. It prevents an electronic signature from being placed on a Legal Consolidated POA.
Which Australian jurisdictions allow Online POA signing?
The rules for Enduring Powers of Attorney are:

Only New South Wales and Victoria provide an online witnessing route. Victoria also permits a true electronic signature. Legal Consolidated still requires wet ink.
Queensland excludes enduring POAs from its electronic execution regime under the Property Law Act 2023 (Qld) s 46.

Similarly, Western Australia, South Australia, the Australian Capital Territory, Tasmania and the Northern Territory require physical signing and in-person witnessing.
Who Witnesses a POA for Free?
With all Enduring and Medical documents, Legal Consolidated provides a full list of persons who can witness your documents in your home state. Start with the free in-person option. Most jurisdictions include a doctor, pharmacist, or JP in the permitted pool of witnesses. Follow the Legal Consolidated signing instructions. Each jurisdiction has a different witness list.
NSW is different. A doctor, pharmacist or JP is not a prescribed witness for an NSW Enduring Power of Attorney. In NSW, a Local Court registrar is a prescribed witness under Powers of Attorney Act 2003 (NSW) s 19. Make an appointment. The service is free.
How Is a NSW POA Witnessed Online?
If the Local Court has no appointment or declines to witness the document, NSW provides an online route.
NSW permits video witnessing under pt 2B of the Electronic Transactions Act 2000 (NSW). The POA maker still signs in wet ink. The lawyer watches the signature in real time.
The process is straightforward:
- The lawyer checks the POA maker’s identity, explains the POA and confirms that the person appears to understand it.
- The POA maker signs the document in wet ink while the lawyer watches.
- The signed document is scanned and sent to the lawyer.
- The lawyer signs the document or an exact copy and adds the statutory remote-witnessing endorsement.
This is not an ordinary Zoom call. Every statutory step must be completed. Do not improvise with DocuSign and hope the document works.
How Is a Victorian POA Witnessed Online?
Victoria permits electronic signatures and video witnessing for Enduring Powers of Attorney. The remote procedure under Powers of Attorney Act 2014 (Vic) s 33 applies.
Every step takes place on the same day. Every participant must be physically located in Victoria. One witness must be an Australian legal practitioner or a Victorian JP.
Legal Consolidated still requires a wet-ink signature. The video link changes where the witnesses sit. It does not change the signing rule.
Can Medical and Lifestyle Documents be signed over the Internet?
The POA rules do not automatically apply to medical and lifestyle documents.
NSW permits video witnessing of an Appointment of Enduring Guardian. The signatures remain handwritten.
A Victorian Enduring Power of Attorney covering personal matters follows the Victorian remote procedure. An Appointment of Medical Treatment Decision Maker must be signed by hand and witnessed in person.
A South Australian Advance Care Directive also requires wet-ink signing and in-person witnessing.
